The FCA took over the regulation of Consumer Credit in April 2014.The new rules broadly follow the requirements previously set by the OFT, however there are some important differences. These are set out in the CONC rules. In the case of the Motor Trade, Dealers need to be aware affordability is still an issue, however the most pressing may be finance product suitability. We need to record why a PCP contract was offered and potentially why a particular provider was selected. Please feel free to contact us if you would like more information.
This aspect of CONC, is causing a great deal of concern. What must or can be included in an advertisement is sometimes unclear. A number of motor manufactures and finance providers have withdrawn their advertising guidance, leaving Dealers without support. Peak Consultants has considerable experience in this area and can assist with training and sign off procedures.
FCA Add on Products MS14/1
The Financial Conduct Authority have released the final version of their Market Study into Add-on insurance products.They now will start a consultation period before releasing their final remedies. GAP will feature in these changes. The potential remedies include a deferment period, preventing the sale of GAP at point of sale, a defined method of product or price disclosure or the use of a comparison website. In any event Dealers will need to demonstrate that they have appropriate controls in place before selling this product.
