. This page sets out the Terms of Engagement for the appointment of Clarkewood Limited to act for You.

a. “Claim(s)” means Your Claim(s) against the Company or Companies relating to the mis-selling of a payment protection insurance (PPI) policy or policies on any account with that Company and a missold packaged bank account or any other financial product or arrangement such as payday loans, mortgages, investments and pensions.

b. “Claims Services” means preparing, submitting and negotiating Your Claim(s) to the Company once we have located a missale. We will not litigate on any of our claim types.

c. “Company” means the financial institution to whom the Letter of Authority is addressed, being the credit card, store card, loan, lender, bank, insurer or other entity that provided/sold the financial product.

e. “Cooling off Period” means 14 days from the date the Claim(s) are submitted to the Company during which time You may cancel the Claim(s) free of charge.

g. “Letter of Authority” means the document to be sent to the Company containing Your authority for us to act on Your behalf.

a. These are the Terms on which we agree to provide the Claims Services and You agree both to be bound by them and to acknowledge them once we have received Your Instructions to proceed with Your Claim(s).

b. That You are aware that You could complain directly to the Company at no cost, with the ability to take matters further with the FOS or Court.

c. If we identify PPI on a policy or account we will send You a Lender Questionnaire or a PBA Questionnaire for PBA claims or a relevant FSCS Questionnaire for other claims. We will not process Your Claim(s) until we receive Your Instructions. You can provide Your Instructions in one of two ways; either by returning the Questionnaire to us or by completing the Questionnaire over the telephone with us.

h. You understand that by completing one PPI or PBA Questionnaire and one Letter of Authority, that the Lender may investigate all accounts where PPI or a PBA has been applied, under the consent provided and that any successful Claim(s) will be subject to a Fee, as set out in clause 4.

i. You will ensure that any information provided is accurate and true to the best of Your knowledge.

j. Where we believe that a financial product may have been mis-sold to You, we will submit a detailed Claim to the Company and/or the FOS and/or the FSCS upon Your Instruction(s).

l. You will inform us promptly of any relevant matters affecting the Claim(s), such as direct contact from the Company and read carefully and retain any claims documentation.

n. We will promptly notify You if we decide not to pursue Your Claim(s) and cancel this Agreement under clause 5 and will not claim for you if you are in an IVA without the instructions of your IVA and cannot act for you if you are bankrupt or after an IVA or Bankruptcy if the financial product was in existence at the time of the IVA or Bankruptcy.

t. You will not be liable for any Fees or charges if the Claim(s) is pursued and the Company pays no Compensation except where this Agreement is cancelled in accordance with clause 5, in which case a cancellation charge may be payable.

v. Our total liability to You in respect of all other losses arising under or in connection with this Agreement, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the amount of any Compensation to which You are entitled for the Claim(s) in connection to which we are liable unless those losses were foreseeable by both parties when the Agreement was signed.

b. If we are successful in obtaining Compensation then You owe us 39% of the Compensation plus VAT. This means, for example: if we succeed in obtaining Compensation of £1,000, the Fee would be £390.00 plus VAT = £468.00. You would receive £532.00. If we succeed in obtaining Compensation of £15,000, the Fee would be £5850 plus VAT = £7020. You would receive £7980. If Compensation of £1,000 is received but £500 is used by the Company to reduce Your outstanding balance the Fee would be £390 plus VAT, therefore You would receive £32 (£500 less our Fee including VAT of £468). VAT is charged at the prevailing statutory rate. Should the VAT rate change this will result in a possible increase or decrease in the Fee. The claims process can take years because of the volume of complaints. We have to charge VAT, VAT no is 207754406.

c. Fees plus VAT become due and payable at the point that either we or You are informed that Compensation is payable by the Company or when an offer of Compensation is made by a Company to You, whichever is the earlier. If the Company offers or pays Compensation to You directly, You agree to notify us immediately (and within 7 days at the latest) and to provide the details we need to calculate the Fee plus VAT. For the avoidance of doubt, should You reject a reasonable offer of Compensation, the Fee plus VAT remains due and payable on the sum offered.

d. Compensation may be used by a Company to reduce any outstanding debt You owe them and You understand that our Fee of 39% plus VAT will be payable to us based on the total amount of calculated Compensation even if the Company does not pay the whole sum of the Compensation to You. We will invoice You for the Fee plus VAT which will become immediately due and payable by You to us.
