We are a Engineering Design Company Based in the UK, who have a client list from Crane service Suppliers to Multinational Oil companies. We are able to look at and assess problems to find the ideal solution. We also own the WearSheave™ and the patent rights.
We have been using the WearSheave™ 3 part System supplied by HHR Enterprise on the Platform for a number of years and have found them to Very cost effective.
HHR ENTERPRISE LIMITED – TERMS AND CONDITIONS FOR THE SUPPLY OF GOODS – (the Conditions)
Business Day: a day (other than a Saturday, Sunday or public holiday) when banks in London are open for business.
Customer: the person, firm or company who purchases the Goods from the Supplier.
Supplier: HHR Enterprises Limited (registered in England and Wales with company number 08380515).
2.3 The Customer shall be responsible for ensuring that all details in the Order, including the measurements specified are accurate. The Supplier shall not be liable for the accuracy of any details provided by the Customer.
2.8 A quotation for the Goods given by the Supplier shall not constitute an offer. A quotation shall only be valid for a period of 20 Business Days from its date of issue.
4.3 Any dates quoted for delivery are approximate only, and the time of delivery is not of the essence. The Supplier shall not be liable for any delay in delivery of the Goods that is caused by a Force Majeure Event or the failure of the Customer to provide the Supplier with adequate delivery instructions or any other instructions that are relevant to the supply of the Goods.
4.4 If the Customer fails to accept delivery of the Goods within 3 Business Days of the Supplier notifying the Customer that the Goods are ready, then, except where such failure or delay is caused by a Force Majeure Event or the failure of the Supplier to comply with its obligations under the Contract:
(a) delivery of the Goods shall be deemed to have been completed at 9:00 am on the third Business Day following the day on which the Supplier notified the Customer that the Goods were ready;
4.5 If 10 Business Days after the Supplier notified the Customer that the Goods were ready for delivery the Customer has not taken delivery of them, the Supplier shall have the right (without giving notice to the Buyer) to dispose of the Goods in any manner it sees fit, including re-selling the Goods and retaining any proceeds of sale.
4.7 The supplier shall not be liable for any failure to deliver any or all of the Goods to the Customer unless the Customer informs the Supplier in writing of the non-delivery within 2 Business days of the date when the Goods would in the ordinary course of events have been received.
4.8 If the Supplier fails to deliver the Goods, its liability shall be limited, at the Supplier’s sole option, to replacing the Goods within a reasonable time or where payment for such Goods has already been made by the Customer, crediting the Customer with the relevant amount of the Total Contract Price. The Supplier shall however have no liability for any failure to deliver the Goods to the extent that such failure is caused by any factor outside of the Supplier’s reasonable control or a Force Majeure Event or the failure of the Customer to provide the Supplier with adequate delivery instructions or any other instructions that are relevant to the supply of the Goods.
(c) the Customer (if asked to do so by the Supplier) returns such Goods to the place of business of the Supplier at the cost of the Customer,
(b) the defect arises because the Customer failed to follow any instructions of the Supplier as to the storage, commissioning, installation, use and maintenance of the Goods or (if there are none) good trade practice regarding the same; or
5.5 Except as provided in this clause 6, the Supplier shall have no liability to the Customer in respect of the failure of the Goods to comply with the warranty set out in clause 5.1
(f) give the Supplier such information relating to the Goods as the Supplier may require from time to time, but the Customer may resell or use the Goods in the ordinary course of its business unless the Customer becomes subject to any of the conditions in clause 9.2.
6.4 If before title to the Goods passes to the Customer the Customer becomes subject to any of the events listed in clause 8.2, or the Supplier reasonably believes that any such event is about to happen and notifies the Customer accordingly, then, provided that the Goods have not been resold, or irrevocably incorporated into another product, and without limiting any other right or remedy the Supplier may have, the Supplier may at any time require the Customer to deliver up the Goods and, if the Customer fails to do so promptly, enter any premises of the Customer or of any third party where the Goods are stored in order to recover them.
