If an incident occurred in the workplace whereby a member of staff or visitor received an electric shock due to a fault with the electrical installation or equipment being used, the likely outcome will be of someone, most likely the dutyholder, landlord or building manager being prosecuted for failing to comply with a duty. In a court of Law it will be the accused to show and provide evidence that it was not reasonably practicable for the accused to do more than what had in fact been done to comply with current legislation (section 40 of the Health & Safety at Work Act 1974). In this case the evidence that the courts will undoubtedly ask for will be current periodic inspection and test reports, certification, test results etc… and that all safety measures, procedures, R & M statements and work permits (signed off), were followed. In such cases the accused is guilty until proven innocent.
