A parent or guardian can make a claim on behalf of a child injured in a cycling accident. A claim can be made on behalf of a child at any time up to their 18th birthday. The child then has until their 21st birthday to start a claim themselves if they wish. In certain circumstances, a claim can be made on behalf of an adult who is considered by the Courts to be unable to conduct their own claim. Such Claimants are known as ?protected parties'. The person making a claim on behalf of a child or protected party is called a litigation friend'. The litigation friend will be responsible for communicating with the solicitors and making decisions in respect of the claim. Whether the claim goes to Court or not, a settlement agreed on behalf of a child or protected party must be approved by the Court in an informal hearing.
